L´objectif général de ce travail est double : d'une part, il consiste à fournir une alternative, par rapport aux résultats de la New Law an Economics de l´École de Chicago, d´autre part, à redéfinir l´objet d´étude de l´analyse économique et à étendre son champ d´application.

 Dans une première partie, j´expliciterai les limites des différents régimes de propriété privée et je montrerai Dans une seconde partie je construirai une fonction de bien-être collectif qui incorpore les consommations individuelles, les modalités de préservation et de croissance du stock de biens collectifs, les modalités d´exclusion et les coûts de transaction. Dans une troisième partie, et je définirai le concept de viabilité d´un mode de gouvernance donné.

Social Choice, governance and commons : towards an ecological Economy

This paper aims (a) to provide an alternative, compared to the results of the New ar Law Economics and (b) to expand the scope of economic analysis in relation to sustainable development;

In the first part, I will highlight the limits of different regimes of private property in a second part I will build a function of social welfare that incorporates individual consumption, methods of preservation and growth of the stock of public goods , patterns of exclusion and transaction costs. In a third part, and I will define the concept of sustainability of a given mode of governance. ;
